Case Spotlight: 3rd Party Misrepresentation / Exaggeration
What Happened?
The incident involved a third‑party motorcyclist who cut across our insured’s path, causing a collision. Liability was immediately disputed. However, our insured had dashcam footage capturing the third party performing the dangerous manoeuvre. It was evident that the third party was fully at fault, and there was nothing more the insured could have done to avoid the impact.
Despite this, the third party attempted to hold our insured responsible. Their letter of claim stated that he had been stationary when the policyholder allegedly drove into the rear of his vehicle, an assertion completely contradicted by the dashcam footage.
Soon after, we received an excessive credit hire claim. At this point, we escalated the matter to our Fraud Specialist Solicitors to conduct further investigations and defend the case in full.
What We Uncovered
Intel searches revealed two key findings:
- The third party had been away for two weeks during the hire period.
- His driver’s licence was fake.
These discoveries were presented to the claimant solicitors, with a request for their position within 48 hours, as we were prepared to make an Application to rely on the evidence at Trial.
Shortly afterward, the third party discontinued his claim, resulting in a significant saving of £42,000.
